This policy applies to patients, customers, representatives and visitors and serves as Lumina’s public information-governance policy. It applies Quebec health-information and private-sector privacy law, and PIPEDA where applicable. Bina is a separate entity.

Depending on the service, Lumina collects only what is needed: identity and contact information; representative; order and prescriber;safety-relevant information; consent; clinical photographs; specimen identifier, type and chain of custody; results; appointments; communications; billing and payment token; and technical information and cookie choices.
This information is used to verify identity and the order, assess eligibility and safety, schedule and document the service, identify and transport a specimen, receive and deliver a result, provide follow-up, bill, answer requests and comply with law.
Consent is clear, separate and proportionate. Refusal to provide necessary information may prevent the service requiring it but does not affect unrelated services. Marketing and promotional use of a photograph are optional, written and separate from clinical consent. They may be withdrawn for the future.
Consent required to use or disclose health information must be freely given, informed, specific and express. Before age 14, it is given by the person having parental authority or tutor; from age 14, by the minor, unless the law provides otherwise.
A photograph needed for assessment, safety, or follow-upforms part of the record and is retained under applicable rules.
Lumina and Bina do not automatically share all information. In the usual specimen pathway, Bina orders the test and collects the specimen, Lumina charges and coordinates shipment, CDL Laboratories analyzes it, and the result is delivered in MYLE to the ordering professional. Each entity uses only what is necessary for its role.
If another laboratory or provider is involved, its identity and processing destination are disclosed before purchase when material. Disclosure is based on consent, the requested service, a permitted contract or law.
Role-based access is limited to authorized professionals and clinical, administrative, billing, privacy, and technology personnel. Responsibilities are defined, access is reviewed, and personnel receive onboarding training and periodic reminders.
Providers support MYLE/MEDFAR records, Square payment and booking, communications, hosting, security, and consented analytics. They receive only necessary information and are subject to contractual safeguards. Before possible processing outside Quebec, Lumina conducts the required assessment and implements safeguards. These assessments do not override the restriction prohibiting physicians from storing their clinical records outside Quebec.
Lumina separately publishes its current technology products and services register and reviews governance, risks, incidents, training and technology at least annually and after a material change.
Strictly necessary cookies may operate without consent. Analytics, advertising and non-essential functions remain off until the user chooses them, and the choice can be changed in cookie settings.
Clinical results are delivered through MYLE or the responsible professional. Do not send urgent or detailed information through general chat. Calls are not recorded. Promotional messages require applicable consent and include an unsubscribe method.
Lumina uses access controls, authentication, encryption where appropriate, confidentiality agreements, backups and logging. It retains information for the purposes and legal or professional requirements, then securely destroys it or anonymizes it where permitted.
For clinical records governed by physicians’ rules outside institutions, the applicable minimum is 10 years after the last entry or insertion, subject to transitional rules for paper records held on July 11, 2024 and preservation duties. Other professions’ rules apply to the relevant records. You may ask the privacy officer about the retention period applicable to your information.
Lumina investigates an incident, limits its effects, records it and notifies affected people and authorities when the legal threshold is met.
Subject to legal exceptions, you may request access, correction, a copy in a structured technological format where applicable, withdrawal of consent and other rights provided by law.
For health information, the law also provides rights to restrict access and refuse certain uses or disclosures, including to certain relatives, researchers or for donation solicitations, subject to statutory exceptions. Exercising these rights does not compromise entitlement to services. Access, transcription, copying and transmission are free. You may consult the disclosure register within legal limits. Withdrawal of consent does not allow deletion of information that must be retained.
Write to confidentialite@binamd.ca with enough information to verify identity. Lumina targets acknowledgement within five business days and responds to access or correction requests within 30 days after receipt. You may also contact Quebec’s Commission d’accès à l’information.
A refusal of access or correction must be explained in writing with the applicable remedies. You may complain to the privacy officer or contact the Commission directly.
A revised version is published with its effective date. Appropriate notice and renewed consent are sought if a change materially alters a purpose or use of sensitive information.
